Welcome to MysticVerse. By accessing or using our platform, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using the Service.

1. Acceptance of Terms

By creating an account or otherwise accessing or using MysticVerse (the "Service"), you confirm that you are at least 13 years of age, that you have read and understood these Terms, and that you agree to be bound by them. If you do not agree to these Terms, do not use the Service.

2. Description of Service

MysticVerse is a creator and community platform that enables users to stream live content across multiple platforms, create AI-powered content (thumbnails, scripts, graphics), engage with communities, participate in challenges and gaming, earn achievements and rewards, and connect with other creators and fans. Our AI tools help creators generate high-quality content efficiently. We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice.

3. Accounts and Registration

• You must provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are solely responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Content

"User Content" means any content you submit, post, or transmit through the Service, including streams, videos, clips, messages, posts, and profile information.

• You retain ownership of your User Content, but you grant MysticVerse a worldwide, non-exclusive, royalty-free license to use, reproduce, display, and distribute it in connection with providing the Service.
• You are solely responsible for your User Content and the consequences of sharing it.
• You represent and warrant that your User Content does not violate any third-party rights, including copyright, trademark, or privacy rights.
• We may remove any User Content that violates these Terms or our Community Guidelines.

5. Prohibited Conduct

You agree not to:

• Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
• Stream or share content that is sexually explicit, gratuitously violent, or promotes self-harm.
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity.
• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to gain unauthorized access to any part of the Service or any other system or network.
• Upload or transmit viruses, malware, or other malicious code.
• Spam, phish, or engage in any other deceptive practices.
• Harass, bully, or intimidate other users.
• Engage in cheating, exploiting bugs, or using unauthorized third-party software in games or platform features.
• Sell, trade, or transfer your account to another person without our consent.

6. Community Guidelines

MysticVerse is committed to maintaining a safe and welcoming community. All users are expected to treat others with respect and dignity. Violations of our Community Guidelines may result in content removal, account suspension, or permanent ban at our sole discretion.

7. Points, Rewards, and Virtual Items

• MysticVerse offers a points system, badges, achievements, and other virtual items ("Virtual Items") earned through streaming, engagement, and platform activities.
• Points can be used to redeem items in our Store, including featured stream slots, premium badges, and other exclusive perks.
• Virtual Items have no real monetary value and cannot be exchanged for cash or transferred outside the platform.
• Points can be purchased through our payment system for use in AI content generation tools and store redemptions.
• We reserve the right to modify, delete, or adjust Virtual Items or their values at any time without liability.
• Points and rewards earned through challenges or platform activity are subject to change based on platform updates.
• Any abuse of the rewards or points system may result in forfeiture of earned rewards and account suspension.

8. Streaming and Broadcasting

• You are responsible for ensuring you have the necessary rights to stream any content, including music, games, and third-party materials.
• You must comply with the terms of service of any third-party platforms you stream to via the Service (e.g., Twitch, YouTube, Kick, TikTok, Facebook, Trovo).
• Multi-platform streaming via Restream is available; you are responsible for maintaining valid credentials with connected platforms.
• We are not responsible for any violations of third-party platform terms that occur through your use of our streaming features.
• We may suspend streaming capabilities if we reasonably believe you are violating these Terms or applicable law.

9. Monetization and Payments

• If the Service offers monetization features (tips, donations, subscriptions, sponsor campaigns), you agree to comply with all applicable payment terms.
• MysticVerse may charge fees for certain features; any applicable fees will be disclosed at the time of purchase.
• All purchases are final unless otherwise required by applicable law.
• You are responsible for any taxes applicable to your transactions on the platform.

9a. Points Purchases

• MysticVerse Points ("Points") may be purchased in one-time packages (e.g., 100, 500, 1,000, and 2,500 Points) through Stripe.
• Points are Virtual Items (see Section 7), have no real monetary value, and are non-refundable except where required by applicable law.
• Points purchases are processed immediately and are not eligible for chargebacks except as permitted by your payment provider's dispute policy.

9b. Payment Processing

• Payments are processed by Stripe, a third-party payment processor. We do not store your full card or bank account details on our servers; such information is handled directly by Stripe in accordance with its terms and privacy policy.
• You must be at least 18 years old (or the age of majority in your jurisdiction) to make any purchase on the Service, or have parental or guardian consent to do so.
• You represent that all payment information you provide is accurate and that you are authorized to use the payment method provided.

10. Intellectual Property

All content, features, and functionality of MysticVerse — including but not limited to the design, text, graphics, logos, and code — are owned by MysticVerse or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

11. AI Content Generation and Third-Party Services

The Service may integrate with or contain links to third-party services (such as Twitch, YouTube, Spotify, Restream, Replicate, FAL, Runway, and others). These services are governed by their own terms and privacy policies, and we are not responsible for their content or practices. Your use of third-party services is at your own risk.

Our AI content generation tools may use third-party AI models and services to generate thumbnails, scripts, graphics, and other creative content. These tools process your prompts and reference images through these services. You agree that any content generated is subject to the terms of the underlying AI service providers. MysticVerse is not responsible for the quality or accuracy of AI-generated outputs.

12. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated by reference into these Terms.

12a. Copyright and DMCA

We respect the intellectual property rights of others and expect our users to do the same. If you believe that any content on the Service infringes your copyright, you may submit a takedown notice under the Digital Millennium Copyright Act (DMCA) by contacting us through the Privacy Support page within the application. Your notice must include:

• A physical or electronic signature of the copyright owner or an authorized agent;
• Identification of the copyrighted work you claim has been infringed;
• Identification of the material that is claimed to be infringing and its location on the Service;
• Your contact information, including your full name, mailing address, telephone number, and email address;
• A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
• A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

We reserve the right to remove infringing content and to terminate accounts of users who are repeat infringers, in appropriate circumstances.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, MYSTICVERSE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MYSTICVERSE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

15. Indemnification

You agree to defend, indemnify, and hold harmless MysticVerse, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from your use of the Service, your User Content, or your violation of these Terms.

16. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violations of these Terms. Upon termination, your right to use the Service immediately ceases. Provisions that by their nature should survive termination will remain in effect.

17. Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in New York.

18. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by updating the "Last updated" date and, where appropriate, by providing additional notice within the Service. Your continued use of the Service after changes constitute your acceptance of the updated Terms.
